{"id":13799,"date":"2021-07-18T12:17:00","date_gmt":"2021-07-18T10:17:00","guid":{"rendered":"https:\/\/blog.casaomnia.it\/?p=13799"},"modified":"2026-02-16T13:15:01","modified_gmt":"2026-02-16T12:15:01","slug":"fence-wall-in-the-garden","status":"publish","type":"post","link":"https:\/\/casaomnia.it\/en\/blog\/fence-wall-in-the-garden\/","title":{"rendered":"FENCE WALL IN THE GARDEN"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\" id=\"h-muro-di-recinzione-introduzione\">FENCE WALL: INTRODUCTION<\/h2>\n\n<p class=\"wp-block-paragraph\">Condominio: a wall of recinzione and delimitation of a <a href=\"https:\/\/casaomnia.it\/category\/esterni\/\">garden <\/a>of exclusive property cannot of itself be considered included between the common parts. This is because such a good can be included among the indicated condominium things only where it objectively results the different destination to the necessary common use. That is, where there is a negotiation title that expressly considers said artifact of common property.<\/p>\n\n<p class=\"wp-block-paragraph\">The <strong>wall of fence is <\/strong>that construction that serves to delimit the property, to divide precisely two lands that are yards, land, <a href=\"https:\/\/casaomnia.it\/en\/blog\/resistant-balcony-plants-tips\/\">gardens<\/a>.<\/p>\n\n<p class=\"wp-block-paragraph\">Any construction placed on <strong>adjoining land<\/strong> shall be a minimum distance from other construction of at least ten feet. Article 873 of the Civil Code states that: \u201cconstructions on adjacent land, if not joined or adhering, must be kept at a distance of not less than three meters. In local regulations may be established a greater distance.<\/p>\n\n<p class=\"wp-block-paragraph\">This rule also applies to the fence wall, which can not be built less than three meters from the border.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-art-873-cc\">ART. 873 CC.<\/h4>\n\n<p class=\"wp-block-paragraph\">The \u201cboundary\u201d (or \u201cfence\u201d) wall is referred to in Art. 878 c.c. which in the first paragraph provides that the boundary wall and any other isolated wall that does not have a height greater than three meters is not considered for the calculation of the distance indicated by<strong>art. 873<\/strong>cc.<\/p>\n\n<p class=\"wp-block-paragraph\">The jurisprudence clarifies when a wall can be qualified as a boundary wall (or fence) that is, when there are certain characteristics:<\/p>\n\n<ul class=\"wp-block-list\"><li>It shall not exceed ten feet in <strong>height<\/strong>;<\/li><li>It must emerge from the <strong>ground<\/strong>;<\/li><li>It needs to be <strong>intended<\/strong> solely to demarcate the boundary line;<\/li><li>Must be isolated, i.e., <strong>detached<\/strong> on both faces from other construction.<\/li><\/ul>\n\n<p class=\"wp-block-paragraph\">The boundary wall, not to be considered for the calculation of distances in buildings, according to art. 878 c.c., is only the one with faces emerging from the ground that, being intended for the demarcation of the boundary line and the separation of funds, it is presented separate from any other construction and, therefore, exceeds this notion the wall erected in elevation of a building, to delimitation of a roof terrace of this, since such an artifact is not configured separate from the building to which it pertains and remains in the same incorporated (Civil cassation no.8922 of April 6, 2017).<\/p>\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"930\" height=\"650\" src=\"https:\/\/casaomnia.it\/wp-content\/uploads\/2021\/02\/csm_gallery_1-1501231777_de4fc7a340.jpg\" alt=\"wall\" class=\"wp-image-12356\" srcset=\"https:\/\/casaomnia.it\/wp-content\/uploads\/2021\/02\/csm_gallery_1-1501231777_de4fc7a340.jpg 930w, https:\/\/casaomnia.it\/wp-content\/uploads\/2021\/02\/csm_gallery_1-1501231777_de4fc7a340-300x210.jpg 300w, https:\/\/casaomnia.it\/wp-content\/uploads\/2021\/02\/csm_gallery_1-1501231777_de4fc7a340-768x537.jpg 768w\" sizes=\"auto, (max-width: 930px) 100vw, 930px\" \/><\/figure><\/div>\n\n<h4 class=\"wp-block-heading\" id=\"h-art-1117\">ART. 1117<\/h4>\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.condominioweb.com\/art-millecentodiciassette-codice-civile.12995\">Art. 1117 Cc<\/a> It considers the <strong>common property of the owners of the individual real estate units of the building<\/strong>, regardless of any periodic enjoyment of the property and, without prejudice to the different ownership resulting from the title, \u201call parts of the building necessary for common use, such as the land on which the building stands, the foundations, the main wall, the pillars and load-bearing beams, the roofs and flat roofs, the stairways, the entrance doors, the vestibules, the passageways, the porticoes, the <a href=\"https:\/\/casaomnia.it\/spiaggia-in-giardino-lusso-per-pochi\/\">courtyards <\/a>and the facades.<\/p>\n\n<p class=\"wp-block-paragraph\">2. areas intended for parking as well as rooms for shared services, such as the concierge, including the doorman\u2019s quarters, laundry, drying rooms and attics intended, due to their structural and functional characteristics, for common use;
