{"id":13809,"date":"2021-07-18T12:17:00","date_gmt":"2021-07-18T10:17:00","guid":{"rendered":"https:\/\/blog.casaomnia.it\/?p=13809"},"modified":"2026-02-16T13:16:09","modified_gmt":"2026-02-16T12:16:09","slug":"mur-de-cloture-dans-le-jardin","status":"publish","type":"post","link":"https:\/\/casaomnia.it\/fr\/blog\/mur-de-cloture-dans-le-jardin\/","title":{"rendered":"MUR DE CL\u00d4TURE DANS LE JARDIN"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\" id=\"h-muro-di-recinzione-introduzione\">MUR DE CL\u00d4TURE: INTRODUCTION<\/h2>\n\n<p class=\"wp-block-paragraph\">Copropri\u00e9t\u00e9 : un mur cl\u00f4turant et d\u00e9limitant un <a href=\"https:\/\/casaomnia.it\/category\/esterni\/\">jardin <\/a>en propri\u00e9t\u00e9 exclusive ne peut en soi \u00eatre consid\u00e9r\u00e9 comme inclus dans les parties communes. En effet, ces biens ne peuvent \u00eatre inclus parmi les \u00e9l\u00e9ments de la copropri\u00e9t\u00e9 que s\u2019il appara\u00eet objectivement qu\u2019ils ne sont pas destin\u00e9s \u00e0 l\u2019usage commun n\u00e9cessaire. C\u2019est-\u00e0-dire lorsqu\u2019il existe un titre contractuel reconnaissant express\u00e9ment l\u2019immeuble comme propri\u00e9t\u00e9 commune.<\/p>\n\n<p class=\"wp-block-paragraph\">Le <strong>mur de cl\u00f4ture est <\/strong>la construction utilis\u00e9e pour d\u00e9limiter la propri\u00e9t\u00e9, pour diviser deux terrains, qu\u2019il s\u2019agisse de cours, de parcelles ou de <a href=\"https:\/\/casaomnia.it\/fr\/blog\/plantes-de-balcon-resistantes-conseils\/\">jardins<\/a>.<\/p>\n\n<p class=\"wp-block-paragraph\">Toute construction sur un <strong>terrain voisin<\/strong> doit \u00eatre distante d\u2019au moins trois m\u00e8tres d\u2019une autre construction. C\u2019est ce que pr\u00e9voit l\u2019article 873 du Code civil, qui se lit comme suit : \u00ab\u00a0Si les constructions sur des terrains contigus ne sont pas jointives ou mitoyennes, elles doivent \u00eatre maintenues \u00e0 une distance qui ne peut \u00eatre inf\u00e9rieure \u00e0 trois m\u00e8tres. Les r\u00e9glementations locales peuvent fixer une distance sup\u00e9rieure\u00a0\u00bb.<\/p>\n\n<p class=\"wp-block-paragraph\">Cette r\u00e8gle s\u2019applique \u00e9galement au mur de cl\u00f4ture, qui ne peut \u00eatre construit \u00e0 moins de trois m\u00e8tres de la limite.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-art-873-cc\">ART. 873 CC.<\/h4>\n\n<p class=\"wp-block-paragraph\">Le mur de \u00ab\u00a0d\u00e9limitation\u00a0\u00bb (ou \u00ab\u00a0d\u2019enceinte\u00a0\u00bb) est mentionn\u00e9 \u00e0 l\u2019art. L\u2019article 878 du Code civil, qui, dans son premier paragraphe, pr\u00e9voit que le mur d\u2019enceinte et tout autre mur isol\u00e9 ne d\u00e9passant pas trois m\u00e8tres de hauteur ne sont pas pris en compte pour le calcul de la distance indiqu\u00e9e \u00e0 l\u2019article <strong>873 du Code civil<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">La jurisprudence pr\u00e9cise quand un mur peut \u00eatre qualifi\u00e9 de mur de cl\u00f4ture, c\u2019est-\u00e0-dire lorsque certaines caract\u00e9ristiques existent :<\/p>\n\n<ul class=\"wp-block-list\"><li>Elle ne doit pas d\u00e9passer trois m\u00e8tres de <strong>haut<\/strong>;<\/li><li>Il doit \u00e9merger du <strong>sol<\/strong>;<\/li><li>Elle doit \u00eatre <strong>destin\u00e9e<\/strong> uniquement \u00e0 d\u00e9limiter la ligne de d\u00e9marcation ;<\/li><li>Elle doit \u00eatre isol\u00e9e, c\u2019est-\u00e0-dire <strong>d\u00e9tach\u00e9e<\/strong> sur ses deux faces des autres constructions.<\/li><\/ul>\n\n<p class=\"wp-block-paragraph\">Le mur de cl\u00f4ture, qui ne doit pas \u00eatre pris en compte pour le calcul des distances dans les constructions, conform\u00e9ment \u00e0 l\u2019art. 878 du code civil, n\u2019est que le mur \u00e0 faces \u00e9mergeant du sol qui, \u00e9tant destin\u00e9 au bornage et \u00e0 la s\u00e9paration des fonds, est distinct de toute autre construction et, d\u00e8s lors, le mur \u00e9rig\u00e9 en sur\u00e9l\u00e9vation d\u2019un b\u00e2timent, pour d\u00e9limiter une terrasse couvrant ce dernier, n\u2019est pas compris dans cette notion, d\u00e8s lors qu\u2019un tel objet n\u2019est pas distinct du b\u00e2timent auquel il se rapporte et reste incorpor\u00e9 \u00e0 celui-ci (cassation civile n\u00b0 8922 du 6 avril 2017).<\/p>\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"930\" height=\"650\" src=\"https:\/\/casaomnia.it\/wp-content\/uploads\/2021\/02\/csm_gallery_1-1501231777_de4fc7a340.jpg\" alt=\"mur\" class=\"wp-image-12356\" srcset=\"https:\/\/casaomnia.it\/wp-content\/uploads\/2021\/02\/csm_gallery_1-1501231777_de4fc7a340.jpg 930w, https:\/\/casaomnia.it\/wp-content\/uploads\/2021\/02\/csm_gallery_1-1501231777_de4fc7a340-300x210.jpg 300w, https:\/\/casaomnia.it\/wp-content\/uploads\/2021\/02\/csm_gallery_1-1501231777_de4fc7a340-768x537.jpg 768w\" sizes=\"auto, (max-width: 930px) 100vw, 930px\" \/><\/figure><\/div>\n\n<h4 class=\"wp-block-heading\" id=\"h-art-1117\">ART. 1117<\/h4>\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.condominioweb.com\/art-millecentodiciassette-codice-civile.12995\">Art. 1117 Cc<\/a> Elle consid\u00e8re comme <strong>propri\u00e9t\u00e9 commune des propri\u00e9taires des unit\u00e9s immobili\u00e8res individuelles de l\u2019immeuble<\/strong>, ind\u00e9pendamment de toute jouissance p\u00e9riodique de la propri\u00e9t\u00e9 et, sans pr\u00e9judice des diff\u00e9rentes propri\u00e9t\u00e9s r\u00e9sultant du titre de propri\u00e9t\u00e9, \u00ab toutes les parties de l\u2019immeuble n\u00e9cessaires \u00e0 l\u2019usage commun, telles que le terrain sur lequel l\u2019immeuble est construit, les fondations, le mur principal, les piliers et les poutres porteuses, les toits et les toits plats, les escaliers, les portes d\u2019entr\u00e9e, les vestibules, les passages, les portiques, les <a href=\"https:\/\/casaomnia.it\/spiaggia-in-giardino-lusso-per-pochi\/\">cours <\/a>et les fa\u00e7ades.<\/p>\n\n<p class=\"wp-block-paragraph\">2. les aires de stationnement ainsi que les locaux destin\u00e9s aux services communs, tels que la loge du concierge, y compris la loge du portier, la buanderie, les s\u00e9choirs et les greniers destin\u00e9s, en raison de leurs caract\u00e9ristiques structurelles et fonctionnelles, \u00e0 un usage commun ;
